Terms of Service
The agreement between you and TinyCMS: what we provide, what you're responsible for as the owner of your site, plans and billing, and what isn't allowed.
On this page
Effective date: October 17, 2026
These Terms are an agreement between you and Blue Line Fabrication, LLC ("Blueline," "we," "us," "our"), which operates TinyCMS. They cover www.tinycms.ai, the TinyCMS app at app.tinycms.ai, the websites we host, our social posting tools, and the TinyCMS connector that lets your AI assistants work on your site and produce content for your site and social media accounts (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you use the Service for a business or other organization, you agree on its behalf and confirm you're allowed to. If you don't agree, don't use the Service.
Our Privacy Policy explains how we handle information and is part of these Terms.
The short version
Your content is yours
You own what you create. You let us store and show it only so we can run your site.
Your site is your responsibility
We host it; you publish it. You must follow every law that applies to what your site says and collects, including privacy laws.
Nothing goes live until you approve it
That includes drafts from AI assistants you connect. What you approve is yours to answer for.
Nothing illegal
Don't use TinyCMS to break the law or to help or encourage anyone else to. We can take down what does.
1. The Service
TinyCMS lets you build, host and run websites and blogs, publish articles, collect form responses, connect analytics tools, post to social media, and work on your site with AI assistants.
Features and limits depend on your plan. We may add, change or remove features over time. If we remove something you pay for in a way that matters, we'll tell you in advance.
2. Your account
- You must be at least 18 and able to enter a binding agreement.
- Give us accurate information and keep it up to date.
- Keep your sign-in secure. We sign you in with codes sent to your email, so protect your email account too.
- You're responsible for everything that happens under your account, including what the people you invite and the AI assistants you connect do there.
- Tell us at [email protected] right away if you think someone has gotten into your account.
3. Plans and billing
- Plans: we offer a Free plan and paid plans, billed monthly or yearly. Prices, features and limits are shown on our pricing page and when you choose a plan.
- Trials: if your plan starts with a free trial, we charge you when the trial ends unless you cancel before then.
- Renewal: paid plans renew automatically at the end of each billing period until you cancel.
- Changing plans: upgrades take effect right away, and you pay the difference for the rest of the period. Downgrades and cancellations take effect at the end of the current period.
- Refunds: fees are non-refundable, except where the law requires otherwise or we say so when you buy.
- Taxes: prices don't include taxes. You're responsible for any that apply.
- Failed payments: if a payment fails and can't be collected, your site moves to the Free plan. It stays online.
- Plan limits: if you're over your plan's limits, such as custom domains or team members, the extras are paused until you upgrade or make room. We don't delete them.
- Price changes: we'll tell you before a price change affects you, and it applies from your next billing period.
4. Your content
You keep all rights to the content you create or upload: text, photos, videos, files, forms, data and designs ("Your Content").
You give us permission to host, store, copy, process, display and send Your Content only as needed to run the Service for you. That includes making the copies and formats your site needs, such as resized images, and sending content to the platforms you choose. This permission ends when Your Content is deleted, except for copies we must keep by law or that remain in backups until they're overwritten.
You confirm you have the rights to everything you put on the Service, and to let us use it this way.
5. Your website and what you're responsible for
We host your site. You're its publisher. You decide what it says, what its forms ask, and which tools run on it, and you're responsible for all of it.
Follow the law. You must follow all laws and regulations that apply to your site and your business. That includes privacy and data protection, consumer protection and advertising, intellectual property, accessibility, and any rules for your industry.
Privacy for your visitors. If your site collects information about people, you must:
- Publish a privacy policy for your visitors that's accurate and meets the law where you and they are.
- Have a lawful reason to collect each piece of information, and get consent where the law requires it.
- Collect only what you need, and keep it only as long as you need it.
- Respond to visitors who ask to see, correct or delete their information.
Forms. You choose what your forms ask for, and you're responsible for collecting and using responses lawfully. Don't use forms to collect passwords, payment card numbers, bank details, government ID numbers, or health information. TinyCMS isn't built to protect that kind of information, and we don't sign agreements, such as HIPAA business associate agreements, to hold it.
Analytics and your own code. If you turn on Google Analytics, Google Tag Manager, Amplitude or another tool, or add your own code, you must follow that provider's terms and the law. For example, tell visitors in your privacy policy that you use these tools, and get consent where it's required. Our consent banner can help, but whether and how to use it is your decision.
When we help you set things up. If our team helps you connect an analytics tool or another service, we're acting on your instructions. The settings and the accounts remain yours, and so does the responsibility for them.
Even if it's a mistake. You're responsible for your site, its content and what it collects, whoever made it (you, someone on your team, or an AI assistant you connected) and whether or not a problem was intended.
6. AI features and assistants
Some features use AI to check, draft or rewrite content, and you can connect AI assistants that work on your site and produce content for your site and social media accounts.
- AI output can be inaccurate, incomplete or similar to other content. Review it before you approve it.
- Nothing goes live until you approve it. Once you approve something, it's your content and your responsibility.
- An assistant you connect acts on your behalf, within the access you give it. Its provider's own terms also apply to your use of it.
- Insights, suggestions and performance numbers are for information only. They don't guarantee traffic, reach, engagement or sales.
7. What's not allowed
You may not use the Service, or let anyone else use it, to:
- Break any law or regulation, or encourage, promote or help anyone else to.
- Sell or promote illegal goods or services.
- Infringe someone else's copyright, trademark, privacy or other rights.
- Publish content that is defamatory, harassing, threatening or hateful, or that promotes violence.
- Publish anything that sexually exploits or endangers children.
- Send spam, run phishing or scams, spread malware, or pretend to be someone you're not.
- Collect information about people without a lawful basis, or collect the sensitive information listed in section 5.
- Get around our security, plan limits or rate limits, or overload or disrupt the Service.
- Copy, resell or rebuild the Service, or try to get its source code, without our written permission.
- Break the rules of the social platforms or other services you connect.
8. When we can act
We don't review everything on the Service, and we have no duty to. But if we reasonably believe content or activity breaks these Terms or the law, or could harm people or the Service, we may remove or disable content, take a page or site offline, pause features, or suspend or close the account.
When we can, we'll tell you first and give you a chance to fix it. We may act without notice when the law requires it, when there's a risk of harm, or when the problem is serious.
9. Copyright complaints
If you believe content on a site we host infringes your copyright, email [email protected] with:
- Your name and contact details.
- The work you believe was copied.
- The address of the page with the content.
- A statement that you believe in good faith the use isn't authorized, and that your notice is accurate.
- Your physical or electronic signature.
We'll review it and may remove the content and tell the site's owner. If your content was removed and you believe that was a mistake, you can reply with a counter-notice. We close the accounts of people who infringe repeatedly.
10. Other platforms and services
The Service works with services we don't control, such as Facebook, Instagram, Threads, LinkedIn, X, YouTube, TikTok, Google and domain registrars. We aren't affiliated with or endorsed by them.
Their terms and policies apply when you use them through TinyCMS. They can change or limit what we can do with them at any time, and we're not responsible for their outages, changes or decisions. By connecting a YouTube account, you agree to the YouTube Terms of Service.
You can disconnect an account at any time. Some features may stop working afterwards.
11. Licensing your content
On plans that include it, you can license your content to others through feeds and an API. If you do, you're the licensor. The terms you agree with each licensee are between you and them, and you must have the rights to license what you share.
12. Site addresses and domains
- Your free address (yourname.tinycms.ai) stays part of our domain. We may reclaim an address that's misleading, infringes someone's rights, or belongs to a closed account.
- You register and pay for your own custom domain with a registrar, under their terms, and you're responsible for keeping it renewed and set up correctly.
13. Data protection
For information about your site's visitors, such as form responses, you're the controller (the one who decides why and how it's used), and we process it on your behalf to run the Service. We use it only for that, as described in our Privacy Policy.
If you need a data processing agreement, for example under the GDPR, email [email protected].
14. Ending this agreement
You can cancel your plan at any time in billing settings, or close your account by emailing us. Before you close your account, download anything you want to keep, such as form responses.
We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Service. If we stop offering the Service, we'll give you reasonable notice and time to take your content with you.
After your account closes, we delete your content as described in our Privacy Policy. The sections on your responsibilities, copyright complaints, disclaimers, liability, indemnity and the law that applies continue after this agreement ends.
15. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted, error-free or completely secure, or that content will never be lost, so keep your own copies of anything important.
16. Limitation of liability
To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, even if we were told they were possible.
Our total liability for all claims relating to the Service is limited to what you paid us for the Service in the one month before the event that led to the claim. If you use the Free plan, that amount is zero.
Some places don't allow some of these limits, so they may not all apply to you.
17. Your responsibility to us
You agree to defend us and to cover our losses and reasonable costs, including legal fees, if someone makes a claim against us because of Your Content, your site, the information your site collects, the tools you add to it, or your breach of these Terms or the law.
18. The law that applies
These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in California, and you and we agree to those courts' jurisdiction.
19. Changes to these Terms
We may update these Terms from time to time. We'll post the new version on this page and change the effective date. If a change is significant, we'll email account holders before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
20. General
- These Terms and our Privacy Policy are the whole agreement between you and us about the Service.
- If part of these Terms can't be enforced, the rest still applies.
- If we don't enforce a part right away, we haven't given up the right to enforce it later.
- You can't transfer this agreement without our consent. We may transfer it as part of a merger, acquisition or sale of assets.
